Currently, all 50 states have .08% blood alcohol concentration (BAC) limit for non-commercial drivers. If you operate a vehicle with a BAC level of .08% or greater, under the law, you are driving while impaired (DWI), or driving under the influence (DUI). In North Carolina, if you have a BAC level of .08% or higher, an automatic revocation of your driving privileges is implemented. In some cases, you may be entitled to a limited restoration of your driving privileges. However, there are specific requirements to be considered for the limited restoration privilege, and your case will need to be evaluated to determine if that privilege would apply. Some of the things to remember if you are charged with a DWI are:

  • In North Carolina, if you refuse a breathalyzer test a mandatory one-year license suspension applies. Refusals are appealable; however, the appellate process is very time sensitive and has stringent deadlines, so it is important that you consult an attorney immediately upon notification from the DMV to begin the appeal process, if applicable.
  • Depending on the circumstances of the DWI/DUI charge, a two-year prison term could be imposed.
  • Costs affiliated with a DWI/DUI charge, such as court costs, fines and other associated fees add up quickly, and it can become an expensive battle.

DWI does not only pertain to alcohol impairment, inclusive in a DWI charge is impairment of (legal and illegal) substances. Some other crimes that can be secondary to DUI include:

  • vehicular homicide, felony death by vehicle, accident cases
  • habitual impaired driving
  • child abuse cases stemming from driving while impaired with a child in the car
  • drugged driving, charges with prescribed meds or not abuse of Xanax, opioids, and other drugs
